GoSkills software includes the GoSkills website and application, and all material available there, including videos, transcripts, quizzes and tests, reference guides, exercise files, certificates, payment mechanisms, brands and slogans, images and designs, and other material.
GoSkills software is intended to enable learners to gain knowledge and learn skills to reach their professional and personal goals, and for organization administrators and creators to manage the learning experience of their organization’s learners, and to create new courses.
We have done our best to make sure the information contained in the software is as accurate and error-free as possible. We reserve the right to make changes to the software without notice. Please contact us if you have suggestions for improvements.
Warranties and liabilities
No warranties, expressed or implied, are given. No liability is accepted for any losses or damage arising directly or indirectly from using the software. Also, no liability is accepted for any losses or damage arising directly or indirectly from events outside of our control, including force majeure or acts of God.
GoSkills is not liable for any disputes, claims, losses, injuries, or damage of any kind that may arise out of or relate to the behavior of users or their interactions with one another.
GoSkills and its affiliates, directors, officers, employees, agents, partners and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to, loss of profits, data, use, goodwill or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your data.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless GoSkills and its affiliates, and their respective directors, officers, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of GoSkills, including, but not limited to, your content, any use of the GoSkills’ content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from GoSkills.
You agree to cooperate with GoSkills in the defense of any claim. GoSkills reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and in such case, you agree to reimburse GoSkills for all reasonable legal fees and costs.
Subscriptions and access rights
If you subscribe to the software, you are granted a non-exclusive, limited licence to access and use the software for your own use for the term of the subscription. These rights automatically expire when the term of the subscription ends. If you choose not to use the software for the whole term, you are not entitled to a refund of money paid for the subscription.
If you purchase a recurring monthly or yearly subscription, your subscription will automatically renew every month or year respectively until you cancel it from your account. You can cancel at any time without affecting your existing access.
Individual subscribers may not allow other people, including from within their business/organization or family, to access the software via their personal subscription. You must notify us immediately if you know or suspect that someone else is using your access information. Other people are very welcome to use the software, but they must arrange their own subscription.
At our discretion, some users may be allowed access to the software on a discounted or free basis, including by redeeming access coupon codes. Such access is non-transferable between users and may be subject to an expiry date.
GoSkills reserves the right to exclude users from the software if they misuse it, without necessarily providing justification.
General conduct
Users of GoSkills are expected to conduct themselves in a manner that is respectful, lawful, and conducive to a positive learning environment. This includes, but is not limited to, refraining from any behavior that is disruptive, offensive, or harmful to others. Users must not engage in any activity that violates local, national, or international laws.
Organization subscribers are responsible for their learners’ conduct and compliance with these Terms.
Content
You are not permitted to reproduce, redistribute, modify, or commercially exploit any materials, including course materials, videos, texts, and software provided by GoSkills, without express written permission from GoSkills. Organizations may reproduce GoSkills Course Template material on the GoSkills platform for access by their learners.
Content that you create on GoSkills must comply with these Terms, applicable laws, and regulations. You must ensure that the content is not defamatory, obscene, offensive, harmful, inaccurate, or misleading, and that it does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
Other prohibited activities
The following activities are strictly prohibited:
- Posting or transmitting any content that is discriminatory, obscene, defamatory, harassing, or in violation of any intellectual property rights.
- Using the service to conduct any fraudulent or illegal activities.
- Introducing malicious software, such as viruses, trojans, worms, or any other harmful code that may damage, alter, or disrupt the service.
- Attempting to gain unauthorized access to any part of the service, including hacking, password mining, or other illicit means.
- Interfering with or disrupting the integrity or performance of the service and its content.
- Creating multiple accounts to abuse GoSkills policies, misuse the service, or deceive other users.
Monitoring and reporting
GoSkills reserves the right to monitor use of its services to ensure compliance with these Terms of Use and protect its users. Violation of these terms may result in a range of actions, including but not limited to, warning the user, suspending or terminating the account, and legal action.
If you encounter any content or behavior that you believe violates these terms, please report it to us immediately to support@goskills.com. We take such reports seriously and will investigate promptly.
Free plan
The GoSkills Free Plan allows organizations limited access to the platform. The features provided on the free plan are subject to change at any time. Use of the free plan is subject to “reasonable use” – the meaning of which shall be determined by GoSkills on a case-by-case basis.
Returns and refund rights
You have the right to cancel within 14 days of first subscribing to GoSkills. If you choose to cancel within this period you may contact us to receive a refund of the purchase price within 30 days.
Access to a GoSkills course cannot be returned or transferred. Refunds after 14 days will not normally be provided, but may be requested and will be considered at the sole discretion of GoSkills.
If you choose not to use the software for the whole term, you are not entitled to a refund of money paid for the subscription; however, if GoSkills is unable to provide the service purchased, we will refund the remainder of the subscription from the date of the refund request.
Jurisdiction and intellectual property
This Agreement shall be governed and construed in accordance with the laws of New Zealand. Copyright law and international treaties protect this software, including all title and intellectual property rights. All intellectual property rights are owned by GoSkills or our licensors.
Course retirement
Courses may be retired from time-to-time at the sole discretion of GoSkills; this particularly affects technology courses where newer product versions replace older versions, but may also apply to other courses.
Referrals
The GoSkills referrals scheme allows you to earn a free month’s access by sharing a unique link. Users referred to GoSkills via your unique link, who then sign up and purchase a course on GoSkills, will earn you a referral. Earning referrals will entitle you to receive a month’s free access to all courses on GoSkills.
Access to a GoSkills course cannot be returned or transferred. Purchases from your unique link that are subsequently refunded will result in the referral and any additional access being voided.

Changes to these terms
We reserve the right to amend these terms of use at our discretion.
